1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the BharatGen HITL Platform (“the Platform”), a human-in-the-loop system for linguistic data sourcing, annotation, and model evaluation across 22 Indian languages. By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Eligibility & Accounts

You must be of legal age to enter into a contract and capable of forming a binding agreement to use the Platform. You are responsible for providing accurate registration information, for maintaining the confidentiality of your login credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorised use. Accounts are personal and may not be shared or transferred without our consent.

3. Acceptable Use

You agree to use the Platform only for lawful purposes and in line with project guidelines. You will perform assigned tasks in good faith, follow annotation and evaluation instructions, and not interfere with the integrity, security, or availability of the Platform.

4. Freelancer & Contributor Obligations and Payment

Freelancers and contributors agree to complete tasks accurately, honestly, and within agreed timelines, and to provide valid payout details for the disbursement of earnings. Payment is calculated based on completed and quality-approved work according to the rates and rules published for each project. You are responsible for any taxes applicable to your earnings. We may withhold or reverse payment for work that is fraudulent, plagiarised, or fails quality review.

5. Intellectual Property & Data Ownership

The Platform, including its software, design, and trademarks, remains our property or that of our licensors. Annotation output, labels, evaluations, and derived datasets produced through a project (“Work Product”) are owned by the client who commissioned the work. To the extent you hold any rights in the Work Product, you assign those rights to us or the client as specified in the applicable project agreement, so that the client owns the annotation output.

6. Confidentiality

You may be given access to non-public materials, guidelines, datasets, and other confidential information. You agree to keep such information confidential, use it only to perform your tasks on the Platform, and not disclose or reproduce it outside the Platform. This obligation survives termination of your account.

7. Content License for Contributed Recordings

If you contribute voice recordings or other content, you grant us and the relevant client a worldwide, royalty-free, sublicensable license to use, reproduce, process, and create derivative works from that content for the purpose of building, training, and evaluating language models and related datasets. You confirm that you have the right to provide the content and that it does not infringe the rights of others.

8. Prohibited Conduct

  • Submitting false, plagiarised, AI-fabricated, or low-quality work in violation of task guidelines.
  • Uploading unlawful, infringing, or offensive content, or content you do not have rights to.
  • Attempting to access data, accounts, or systems you are not authorised to access.
  • Reverse engineering, scraping, or disrupting the Platform, or circumventing security or quality controls.
  • Misrepresenting your identity or eligibility, or creating duplicate accounts to game payments or quotas.

9. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if you breach these Terms, engage in fraud or abuse, or if required by law. You may stop using the Platform and request account closure at any time. Sections that by their nature should survive termination — including intellectual property, confidentiality, disclaimers, and limitation of liability — will continue to apply.

10. Disclaimers

The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Platform. Our total aggregate liability for any claim relating to the Platform will not exceed the amounts paid or payable to you in connection with the relevant work in the three months preceding the claim.

12. Indemnity

You agree to indemnify and hold harmless BharatGen, its affiliates, and clients from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or content you contribute.

13. Governing Law

These Terms are governed by the laws of India. Subject to any contrary agreement, the courts at the seat of our operations in India will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Platform.

14. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
